In order to comply with the European Union (EU) Directive on Distance Selling, the following Terms & Conditions must be agreed to before your order can be processed. These terms and conditions for the sale of goods will govern any contract for sale that we jointly enter into and tell you the rights and obligations you have. Please read these carefully. You may have other rights granted by law and these Terms and Conditions do not affect these. This does not affect your statutory rights as a consumer.

BWY-Shop and its employees make no claim as to the benefits arising from the use of yoga mats &props and this site is in no way intended as a guide on how to practice yoga or how to use yoga props. BWY-Shop products are used entirely at your own risk. Our staff ARE NOT MEDICALLY TRAINED and we advise that you always consult a qualified yoga teacher (or where appropriate a medical practitioner) before using yoga props. BWY-Shopwill not be liable for consequential loses caused by the use of any of the products on this web site howsoever arising.

By placing your order you are offering to buy the goods and permitting us to use your personal details for the purposes of supplying goods (including passing your details onto couriers and other subcontractors). We will not use your details for other purposes other than those stated in our Privacy Statement - below, without asking your consent and you may request that your details are removed from our system by writing to the address above.
 
We are not obliged to supply the goods to you until we have confirmed acceptance of your order and this is when the contract is made. Your credit card payment will be deducted prior to sending the goods ordered though this will usually be within 24hours of the goods being dispatched. You do not own the goods until we have received payment in full. All prices and offers are subject to change and availability. Errors and omissions excepted, subject to not selling below our cost price.

Your satisfaction is essential to our success. If you are unhappy with any of our products we will refund any unused items so long as you return them to us at your expense, in a saleable condition within 30 days of purchase. Please call us for approval before returning any used goods. For larger items it may be more convenient for you if we arrange collection (mainland UK only), if this is the case please call us on 01386 859 553 to make arrangements. In the event of us collecting the goods a carriage charge of £6.50 including VAT will be deducted from the credit due to you. When returning goods be sure to include your details.

We endeavour to supply goods that are free from defects in materials and workmanship. You should inspect the goods when you receive them for defects or damage and notify us as soon as possible if there are any problems so that we can arrange for their collection at no cost to you. We will at our option replace the goods or refund monies paid by you. 

All credit card transactions are undertaken using SSL encryption of a minimum of 40 bit and firewalls, operated by Sec Pay. We endeavour to take all reasonable steps to protect your personal information. However, we cannot guarantee the security of any data you disclose on-line. You accept the inherent security risks of providing information and dealing on-line over the Internet and will not hold us responsible for any breach of security unless this is due to our negligence or wilful default.

BWY-Shop accepts Visa, Mastercard, Switch and debit cards and uses a secure payment system. Cheques can be mailed to us made payable to T.L. Elliott & Co Ltd - please print out your order and send with payment. Please allow seven working days for cheque clearance.

Upon submitting an order using our automated shopping basket system you will receive an E-Mail confirmation. Please check that the details contained in this email are correct. If there are any mistakes, please email us immediately. This e-mail is neither an invoice nor a formal acceptance of your order. An Invoice will follow by post to the purchaser's address. In the unlikely event of us being unable to fulfil your order or part there of, (due to having sold out of a selected item), or there being an error in your order we will advise you as soon as it is possible. If payment has been made on an order that we are unable to fulfil we will immediately refund payment by the same method as the payment made.

The prices shown on the product pages include UK VAT (ex-VAT prices are in brackets), (where applicable)at a rate of 17.5% (VAT No. 589254981). VAT is added automatically in the shopping basket for UK & EU customers. VAT will be deducted for orders placed from outside the EU. Local Taxes & Duties for those outside the EU are the responsibility of the shopper or recipient in the country of destination.

Deliveries within the UK, excluding The Islands are mainly by 2-3 day "signed for" courier service using ANC or Parcelforce, though small items are sometimes sent by the Royal Mail. Goods ordered before 12pm (GMT) will normally be processed and dispatched the same day. Occasionally we may deliver the goods in several consignments but if this is the case we will not charge any extra delivery for this. If we have not delivered the goods within 30 days of expected delivery then you may cancel the contract. We will refund any money paid by you.

If you are a consumer you have the right, in addition to your other rights, to cancel the contract and receive a refund, provided that the goods are returned undamaged and complete, together with the relevant packaging in an unused and re-saleable condition. You must inform us in writing of your desire to cancel within seven working days starting from the day after the day the goods are delivered to you. You must return the goods to us at your cost and we advise you to ensure the goods are adequately insured during any return journey. If you have not returned the goods within 14 days of cancellation or if requested we can collect the goods from you at your cost. Note: If you request us to arrange for a courier collection of your product, we are unable to specify the collection time, and will require someone to be present when the courier comes.
 
If you wish to cancel, please write to us at the address below. We require all cancellation requests in writing, within 7 working days starting on the day after you receive the goods from us. Alternatively fax us on 00 44 (0)1386 859 350 or Email customercare@bwy-shop.co.uk. We shall refund the total amount of money paid by you for the goods, less any costs to collect the goods if required, within 30 days from the day on which we receive your notice of cancellation in writing. Refunds for valid claims will be made via the same method of payment as used to place the order.
